From such a starting point, rhetorical agency describes a communicative process of inquiry and advocacy on issues of public importance. As political action, rhetorical agency often takes on the characteristics of a normative theory of citizenship; a good citizen persuades and is persuaded by the gentle force of the better (...) argument. More radical visions of argument might include strikes, sit-ins, and boycotts in the rhetorical arsenal of good citizenship, and some might even flirt with violence as rhetorical action. This model of rhetorical agency requires a translation of the conceptual apparatus of rhetoric and its alignment with the problematics of democratic theory and actually existing democratic regimes. Classical models that hoped to harness rhetorical agency to the making of the "orator-statesman" (sic) must reimagine political participation in terms of publics and counterpublics, social movements, electoral campaigns, communication media and technologies, as well as supra- and sub-national institutional settings. As the classical norms of citizenship rub against (post) modern realities, a permanent anxiety over the meaning and potential of rhetorical agency seems destined to be lodged in the critical imagination of rhetorical studies. If politics today is, in Jodi Dean's words, "a domain of financially mediated and professionalized practices centered on advertising, public relations, and the means of mass communication," then actually existing rhetorical agency manifests itself in efforts to "raise the money, buy the television time, register the domain names, build the website, and craft the accessible, user-friendly, spectacular message" (2003, 96).If we recognize Dean's description of the political as an accurate description of the rhetorical situation today, rhetorical studies is left with three strategies: It can refashion a deliberative vision of rhetorical agency into a normative ideal for critiquing the structural conditions (capital, media [End Page 188] concentration) of political participation. Second, it can enlarge the field of normatively acceptable ways and means of political participation, for example, by embracing the more spectacular politics associated with visual and body rhetorics. Finally, rhetorical studies can work on the "demand" side and design new strategies and tactics for activating the rhetorical participation of citizens, for example, by encouraging the creation of communicative norms necessary for reinvigorating voluntary and civic organizations. However, while each of these approaches provides a research agenda, none of them gets at the root cause of the anxiety over agency: the attachment of rhetorical agency to a vision of political change. The anxiety over agency pushes rhetorical critics and theorists into becoming moral entrepreneurs scolding, correcting, and encouraging the body politic to improve the quality and quantity of political participation.The purpose of this paper is to offer an escape route from theorizing rhetorical agency as a model of political communication.1 In opposition to a political-communicative vision of rhetorical agency, this paper suggests a different materialist ontology, one that imagines rhetorical agency as a form of living labor. I will argue that rhetorical agency belongs to the domain of communicative labor, a form of labor increasingly necessary to the workings of contemporary capitalist production. In other words, I want to replace a political-communicative model of rhetorical agency with a materialist-communicative model. To highlight the similarities and differences between the two models, I will focus on how the interface between politics, communication, and economics plays out in the Marxist tradition of rhetorical studies. I will organize this tradition into two sections: the first, represented by James Aune, advocates a hermeneutic approach to rhetorical agency, and the second, represented by Dana Cloud, argues for imagining rhetorical agency as a class-based social movement. By focusing on the work of my comrades, the paper risks being received as a "left sectarian" polemic.2 As I will demonstrate in each section, the problem with these two approaches has less to do with Marxism and more to do with how they turn to hermeneutics and social movements to imagine rhetorical agency in the idiom of communication theory. In regards to a phenomenology of law, I wish to investigate Dworkin's theory of law, and subsequently, what is left out in order for it to be considered a phenomenological account. In doing so, I will compare Dworkin's phenomenology of law to Schütz's phenomenology of the social world. Notre Dame, Indiana: University of Notre Dame, 1985. Pp. x + 272. $23.95. The author, recently named dean of Harvard Divinity School, wrote this book as chairman of the Religion Department at Haverford College. A Lutheran, he pays tribute to Hans Frei of Yale University as his principal mentor. Influenced by I<'rei's narrative (...) theology, he argues for a doctrine of revelation understood as God's narrated promise. Narration, Thiemann contends, is essential for revelation, which is the doctrine of God's identifiability. We identify persons by ascribing character traits to them on the basis of their pattrrns of behavior. God\; patterns of hrhavior are made known through the biblical narrative. Promise, for Thiemann, is an essential category hecause it is the mode by which the biblical text encounters its readers, inviting them to put their trust in the God who was the principal agent of the history of Israel and of Jesus Christ. Faith, discerning God's identity ns thr suhject of the biblical text, goes out to him as a living reality. Thiemann's thesis of course implies that Christian revelation is given in the Bible, that the Bible is predominantly narrative, and that the main theme of the biblical narrative is the prevenient God who enacts his intentions and addresses the reader through the text. Faithful discipleship is the appropriate response to God's self-giving love as disc'.oscd in Jesus Christ. Thiemann illustrates these principles <"oncrrtrly hy a ch:ipterlength analysis of the Gospel of 11/fatthew. Thiemann defends his theolog·ical options on the ground that the alternatives do not sufficiently protect the divine prevenience. This doctrine, he holds, must be safeguarded not only because it was formally taught by the Council of Orange but also-and, one would gather, more fundnmentally -because it is implied " by a cluster of Christian convictions concerning God's promises, identity, and reality " (80-81). According to Thiemann it is a " common conviction shared by all those who confess the name of Christ... that all human life, including our theological thinking, is ultimately dependent on the creating, sustaining, and redeeming grace of God" (70). Apart from the rather broad use of the term "grace" this statement would be aceeptahle to very man~' Christians, including myself. In the course of establishing his own position 'l'hiemann develops au 169 170 BOOK REVIEWS incisive critique of a number of rival approaches. He rejects the "foundationalism " of classical apologetics which, as he understands it, would seek to justify Christian faith by reference to some kind of self-evident, noninferential experience from which it could be deduced. On the basis of a critical analysis of Thomas Torrance and several earlier theologians, he concludes that no such unassailable starting point exists. Thiemann also rejects the transcendental turn to the subject, which he ascribes to David Tracy and David Burrell, on the ground that this reduces biblical revelation to a generic human experience and ends by undermining the truth-status of all particular religious claims (187). Finally, Thiemann maintains that new theologies which dispense with the category of revelation (Gerald Downing, Gordon Kaufman) or give it no necessary function (David Kelsey) surrender the Christian conviction of God's prevenience and make faith dependent on purely human initiative. A nonfoundational defense of God's prevenience, according to Thiemann, has three distinct emphases. First, its justification of Christianity is conducted from within a conceptual framework supported by Christian faith, community, and tradition. Second, such a reflection evaluates and criticizes Christian doctrine and practice according to criteria internal to Christian faith. Third, this reflection seeks to justify its tenets holistically, by reference to the structures imbedded in the entire system of Christian beliefs and practices. Thiemann considers it proper to justify individual beliefs retrospectively by showing their importance for defining Christian identity. Thus he tries to show that a rejection of God's prevenience as a "background belief" would require " a radical and unwelcome revision in our understanding of Christian identity" (78). He makes use of " reflective equilibrium" and retrospective justification in ways strongly reminiscent of Francis Schussler Fiorenza's Foundational Theology (1984)-a book possibly published too late for Thiemann to refer to. Both he and Fiorenza, however, rely on authors such as John Rawls. In opposition to the foundationalists Thiemann, wisely in my opinion, eschews any sharp dichotomy between the "first-order" language of faith and the " second-order" language of theology. Christian theology, he maintains, must be carried on within Christian faith and must adopt patterns of speech that are consonant with Christian sources and premises. Theology, he asserts, "has no rationale independent of the first-order language of faith" (75). In particular, he denies that any successful account of Christian belief can be furnished by pointing to the religious experience supposedly available to all human beings. I find myself in agreement with practically all Thiemann's major positions. I applaud his skillful defense of revelation theology without recourse to rationalistic foundationalism or subjectivistic transcendentalism. BOOK REVIEWS 171 In my own Models of Revelation I made little explicit use of the categories of narrative and promise, but they are harmonious with my general approach. I rely more on the category of symbolic or saeramental communication. Thiemann might agree that Israel and Jesus Christ, as God's agents in human history, are in fact " real symbols" of the divine. By their very being they make present the hidden reality of the God who calls created persons through them into union with himself. They are thus pledges and anticipations of the age to come. The category of promise, when applied to such historical figures, could seem to tie revelation too narrowly to certain verbal expressions in the Bible, but Thiemann, while attending primarily to the linguistic component, seems open to the idea of promise "enacted" in the persons and events of the biblical narrative. In this wider understanding promise may be classified as " sacramental." A few shortcomings of the book, or personal difficulties of the present reviewer, should probably be detailed. In writings influenced by Hans Frei, including Thieman's, the biblical narratives seem to be exempted from historical criticism. Thiemann himself discusses them as pure narrative without raising the question of their objective validity. He seems to assume that these stories give true accounts of the way things are, for if they were products of fantasy or illusion they could scarcely bear the theological weight that Thiemann places on them. Granted that " Scripture depicts a God who continually keeps his promises" (154), the reflective inquirer would be justified in asking for some grounds for holding that this depiction is veridical and is not simply wishful thinking. If Thiemann had given more attention to this problem, his book might better succeed in providing, as it claims to do, " a reasoned theological account of Christian faith and hope" (7). Without such assurances the decision of faith could appear arbitrary and irresponsible. I fully agree with Thiemann's insistence on the divine prevenience, but I find some obscurity in his treatment of the connection between God's prevenience and any human response. Does God effectively influence the decision of faith 7 At one point Thiemann asserts that God is " the creator of the universe, the redeemer of a sinful humanity, and the reconciler of a broken world" (108). These terms seem to me to imply causality. Yet Thiemann repeatedly rails against understanding God's prevenience in causal terms (98, 109, et passim). Possibly Thiemann is assuming that causality must necessarily be deterministic, but in many philosophical traditions causality is not so narrowly understood. God's prevenience would be more intelligible if it were presented in causal, though not deterministic, terms. I was not surprised to find in this book certain characteristically Lutheran motifs such as the " unconditionality " of justification and its antecedence to all human merits. Properly understood, this is not simply 172 nooK m~vrnws good Lutheranism but is basic Christian doctrine as understood by Catholics also. Thiemann, however, goes further. At one point, relying on Robert Jenson, he asserts that, on peril of works-righteousness, justification or salvation must not be conceived as any kind of causal process involving interaction between the divine and human agencies. While asserting this, he also denies that human beings are purely passive in their own justification (96-97). The idea that sanctification is a process involving the activity of both God and creatures is well rooted in the Lutheran as well as the Catholic tradition. Perhaps because he treats the whole question so briefly, Thiemann does not seem to me to provide an intelligible alternative. As should be obvious by this point, Thiemann's book deals with a multitude of crucially important questions. It enters into the very heart of the contemporary debate about revelation and theological methodology, and makes many insightful contributions. For the most part, I am enthusiastic about his approach, which seems to offer a highly promising alternative to the theological options he rejects. What I regard as shortcomings in this book are partly due to its relative brevity, granted the vast range of topics on which it touches. But the very breadth of the horizons makes this book especially stimulating and arouses the reader's eagerness to hear more from its talented author. Discourse around assisted colonization focuses on the ecological risks, costs, and uncertainties associated with the practice, as well as on its technical feasibility and alternative approaches to it. Nevertheless, the ethical underpinnings of the case for assisted colonization are claims about the value of species. A complete discussion of assisted colonization needs to include assessment of these claims. For each type of value that species are thought to possess it is necessary to determine whether it is plausible that species possess (...) the type of value and, if so, to what extent their possessing it justifies assisted colonization. I conducted such an assessment for each of the predominant types of value ascribed to species: ecological, instrumental (including option value), existence, and intrinsic value (including interest‐based, objective, and valuer‐dependent intrinsic value). The vast majority of species, including several that have been proposed as candidates for assisted colonization, have much less value than is often presumed. Moreover, with respect to some types of value, assisted colonization would not fully preserve the value of the target species even if it were to keep the target species in existence. Therefore, the case for assisted colonization is significantly weaker and more qualified than its advocates often suppose. There may be exceptional species for which assisted colonization is well justified—and for this reason, case‐by‐case assessment is necessary—but in general the burden of justification generated by the ecological risks associated with assisted colonization is not met by the value potentially preserved by assisted colonization. This suggests that assisted colonization ought to have, at most, a very minor role in the portfolio of ecosystem management practices, even as it pertains to species conservation under conditions of rapid climate change. The purpose of this book is to call the separation of reason and religion into question.

The problem of providing mandated medical care has become commonplace as correctional systems in the United States struggle to manage unprecedented increases in its aging prison population. This study explores older incarcerated women’s perceptions of prison health care policies and their day-to-day survival experiences. Aggregate data obtained from a sample of 327 older women residing in prison facilities in five Southern states were used to identify a baseline of health conditions and needs for this vulnerable group. With an average of (...) 4.2 chronic health conditions, frequently histories of victimization, and high rates of mental health issues, the women’s experiences of negotiating health care was particularly challenging. By incorporating the voices of older women, we expose the contradictions, dilemmas, and obstacles they experience in their attempts to obtain health care. It is clear from the personal accounts shared that, despite court mandates, penal harm practices such as delaying or denying medical treatment as well as occasional staff indifferences are common in women’s prisons. With older women having the greatest need for health care, an age- and gender-sensitive approach is recommended. (shrink)

This paper critically appraises the applied action-guide approach to bioethics and finds it wanting in two ways: it is tethered to a social contract view of the doctor-patient relationship that is largely incompatible with experiences of illness and care; and, as a formalist doctrine, it lacks critical edge and tends toward accommodationism. An alternative approach is recommended that involves interpreting moral experience by means once associated with the rhetorical arts — practical reasoning, hermeneutics, casuistry, and thick description.

Toward the end of the Nomadology plateau of A Thousand Plateaus, Deleuze and Guattari differentiate an ambulant holey space from the smooth space of the nomadic war machine and the striated space of the sedentary State apparatus. Although Deleuze and Guattari only discuss the concept briefly, holey space provides a useful means of framing their remarks on music in general. Music’s holey space is a quasi-territory determined by processes of following sonic movement-matter. Its instruments differ from nomadic weapons and sedentary (...) tools, being characterized by directions of injection, ejection and parajection; the vector of lines of the universe and extemporality; the model of free play; the trait of expression of incantation; and the tonality of affects-percepts. Professor Veatch's writings have a special significance here. In recent years he has been more concerned than most to accept this responsibility, and more concerned than many to insist upon its importance. Drawing out some of the implications of his earlier Intentional Logic and still—as then—relatively unconcerned about the fate of any particular necessary truth, he has attempted to relate a realistic doctrine of necessity to some non-realistic doctrines. His is, it should be remarked, not a realism which for its (...) logical inspiration finds anything of use in such random realists as Peirce or Cook Wilson; rather, there are muffled echoes of the early Russell and Moore, confident quotations from Aquinas, and a very firm reliance on the finality of the Aristotelian predicables. In October of 2009, Trevor Keezer was terminated by Home Depot for refusing to remove a pin from his uniform declaring “One Nation under God, Indivisible.” Mr. Keezer, a cashier with Home Depot, contended that the button he had worn for over one year before any action was taken by his employer expressed his support for American troops and his Christian faith. Were the actions taken by his employer warranted or was Mr. Keezer the victim of arbitrary religious discrimination unrelated (...) to job performance? Religion is becoming an increasingly polarizing issue in the workplace, forcing retail managers to balance the respective interests of employees, coworkers, and patrons of retail establishments. And from all indications, if legislation pending in Congress is enacted, maintaining the balance will become more problematic. (shrink)

ABSTRACTIn April of 2000, Diana Levine went to a clinic in Vermont suffering from a migraine headache. She was given the drug Demerol for the migraine symptoms and Phenergan for nausea. Complications with the administration of Phenergan ultimately resulted in Ms. Levine contracting gangrene, necessitating the amputation of her right arm. Ms. Levine sued the drug maker, Wyeth Pharmaceutical, in state court and prevailed. The lower court's decision was appealed by Wyeth to the state supreme court where the ruling was (...) confirmed. Wyeth next appealed to the U.S. Supreme Court which, to the surprise of many observers, affirmed the judgment of the state supreme court. At issue was the fundamental question of the ability of consumers to obtain redress against negligent manufacturers in state courts. Wyeth's arguments to the Court were based upon preemption: Foodand Drug Administration approval of a drug preempts the ability of injured consumers like Ms. Levine to recover in state courts despite years of precedent to the contrary. Ability to recover damages in state courts represents, perhaps, the most important safety net available to consumers injured by defective products. A ruling by the Supreme Court that FDA‐approved labeling of pharmaceuticals preempts the reach of the state courts would have severely compromised the balance of power between consumers and producers. A salient feature of the book is its searching examination of the different types of value judgement by which all educational discourse is permeated. The analysis of the (...) nature and justification of educational judgements forms the basis of an overall philosophy of adult education which should provide a much needed axiological framework for the guidance of practitioners in this growing area of educational concern.
